Service Satisfaction
If ABF does not meet the service set forth in the TimeKeeper schedule confirmation and the Customer is not satisfied with the TimeKeeper service, ABF will provide remedies on a case-by-case basis. Customer has 45 days from the bill date to file a claim in writing and agrees that forfeiture of freight charges shall serve as maximum restitution for such service failure. Customer may also initiate the claim process by calling 1-800-874-2061. Claims initiated more than 45 days after the bill date shall no longer be eligible for remedy. ABF's signed delivery receipt will serve as documentation of delivery date.
This guarantee will not apply in connection with shipments where the applicable price and service has been designated as Non-Guaranteed.
This guarantee will not apply in connection with shipments experiencing delay due to customs clearance or inability of consignee (or tradeshow contractor) to receive freight. On shipment requiring delivery to exclusive agents, ABF will consider tender to the agent as delivered.
This guarantee will not apply in connection with shipments where the shipper has installed or requested installation of a bulkhead for use in transportation of the shipment.
This guarantee will also not apply to air shipments experiencing delay as a result of the shipment containing any commodity that is restricted from air service by the airline and/or any applicable governing body.
ABF shall not be liable for damages of any kind arising from a delay or other failure by forces beyond our control; including without limitation, acts of God, acts of public enemies or authorities, labor disputes, governmental action or regulation, or unusually severe weather, which has a material effect on ABF's ability to perform.
